At Tumakazi your privacy matters. This policy explains how we handle your personal information when you use our platform as a client. It covers what we collect how we use it and who we share it with. We follow the Kenya Data Protection Act 2019 and other relevant laws.
We collect information you give us directly plus data generated by your activity on the platform.
1.1 Account Details. When you create a client account you provide your name email address phone number and a password. You may also add a profile picture or company details later.
1.2 Project Information. Every project you post including its description budget and timeline is stored. Your communications with freelancers through our messaging system are also kept so you can refer back to them.
1.3 Payment and Escrow Data. All project payments happen through our secure escrow system. We collect billing details needed to process each installment (50% upfront 30% on first milestone 20% on closure) but we never store full card numbers or M‑Pesa PINs. Our payment partner Paystack handles the transaction via the unique Escrow URL we provide to you. We keep records of all escrow deposits and milestone releases for your project history.
1.4 Support Communications. If you contact us via email WhatsApp or our website forms we save that correspondence so we can assist you better.
1.5 Usage Information. We automatically note which pages you visit how you interact with projects and similar technical data. This helps us improve the platform.
We use the data we collect for these purposes:
2.1 Running the Platform. Your account is managed with your details. We display your project posts to freelancers allow you to review bids and facilitate the escrow payment schedule (first installment second installment and final payment).
2.2 Keeping You Informed. We send transactional emails about bid notifications milestone approvals escrow payment confirmations and account security alerts. You can opt out of promotional newsletters but not essential service updates.
2.3 Safety and Integrity. We use your data to verify identities prevent fraud and enforce our Terms and Conditions including the rule that escrow payments must go only through the Escrow URL we supply.
2.4 Improving Your Experience. Analysing how clients use the platform helps us fix bugs and design features that make hiring freelancers smoother.
2.5 Legal Obligations. We process data as needed for tax compliance accounting and responding to lawful requests from authorities.
We never sell your personal data. We only share it in these situations:
3.1 Freelancers You Engage. When you accept a bid the freelancer sees your name company name (if added) project details and the contact information you agree to share. They do not see your full payment details or escrow history beyond the milestones you approve.
3.2 Our Service Providers. Trusted partners help us run Tumakazi. Paystack processes escrow payments via the Escrow URL. Google Workspace delivers our emails. Hosting providers store data. Each partner only gets the minimum data needed and must protect it.
3.3 Legal Requirements. We may disclose information if the law demands it or if we believe it necessary to protect someone’s safety rights or property.
3.4 Business Changes. If Tumakazi is ever merged or acquired your data could be transferred as part of that deal. We will notify you beforehand.
3.5 With Your Consent. Any other sharing will only happen after we get your clear permission.
We keep personal information only as long as it serves a real purpose or the law requires.
4.1 Active Client Accounts. Your data stays on file while you use Tumakazi.
4.2 Account Closure. If you close your account we delete or anonymise your personal details within a reasonable period. Records needed for legal or tax reasons (such as escrow transaction logs) will be kept for at least seven years.
4.3 Project Archives. Completed project summaries and reviews remain visible to maintain marketplace trust. This is true even after a client or freelancer closes their account.
You have clear rights over your personal data. To exercise any right simply email us at privacy@tumakazi.co.ke. We will respond within 30 days.
5.1 Right to Access. Ask for a copy of the data we hold about you.
5.2 Right to Rectification. Correct inaccurate or incomplete information. You can update many details yourself in your account settings.
5.3 Right to Erasure. Request deletion of your data where legally possible. This does not apply to data we must keep for tax or legal purposes.
5.4 Right to Object. Stop direct marketing at any time by using the unsubscribe link in our emails.
5.5 Right to Data Portability. Receive your data in a structured commonly used format.
We use strong security measures. Data in transit is encrypted with SSL/TLS. Our servers are firewalled and access to personal data is strictly controlled. The Escrow URL payment pages are hosted on Paystack’s PCI DSS compliant infrastructure. No system is 100% secure but if we ever detect a breach we will alert you and the relevant authorities as required by law.
Our platform may contain links to other sites (for example a freelancer’s portfolio on Wistia or YouTube). This policy does not cover those third party sites. Please check their privacy terms separately.
Some of our service providers operate outside Kenya. When data is transferred we ensure it receives the same level of protection required by Kenyan law.
Tumakazi is for adults aged 18 and above. We do not knowingly collect data from anyone under 16. Contact us immediately if you believe a minor has shared personal information here.
We may change this policy occasionally. The latest version will always be on our site with the updated date. For material changes we will notify you by email or with a clear notice on the platform.
